1. Acceptance of Terms
By creating an account, subscribing, or using GexTweak ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding contract between you ("User") and GexTweak ("we", "us", "our").
You must be at least 18 years old and legally capable of entering a contract in your jurisdiction.
2. The Service
GexTweak provides options market analytics through this website and the /v2 terminal. Current views include: Chart (candles with dealer exposure, bank zones, dark pool prints and replay), Heatmap (strike × expiration exposure for GEX, DEX, VEX and CHEX, including a Δ DAY mode), Flow (institutional options flow tape), Positioning (opening-flow views), Touch (probability-of-touch alerts), Whales (large prints), Earnings (calendar with expected move), Surge (0DTE contract signals with graded outcomes), and Macro.
Selected alerts can also be delivered to our Discord community. Features may be added, changed, or removed at any time.
The Service is provided "as is" on a best-effort basis. We do not guarantee uptime, data accuracy, calculation correctness, or any specific outcome from using the Service.
3. Accounts
- You are responsible for keeping your login credentials secure.
- You may not share, resell, or sublicense your account access.
- One account per person. Multiple accounts to circumvent tier limits may result in suspension.
- Notify us immediately of any unauthorized account access.
4. Subscriptions & Billing
The Service offers a free tier and paid subscription tiers (Retail, Whale), monthly or annual, as described on the Plans page. Paid tiers grant additional features.
Free trial
Retail and Whale include a 7-day free trial. A payment method is collected at signup and nothing is charged during the trial. Unless you cancel before the trial ends, the subscription begins automatically at the end of the 7 days.
Billing
- Payments are processed by Whop, a third-party payment platform. We do not store full card numbers on our servers.
- Subscriptions auto-renew at the end of each billing period (monthly or yearly) unless cancelled.
- Prices are in USD and exclusive of any applicable taxes.
- Failed payments may result in immediate tier downgrade.
- Plan changes are prorated against the remainder of the current period.
Cancellation
You can cancel anytime from your Account page, through your Whop dashboard, or by contacting us. Cancellation takes effect at the end of the current billing period — you retain access until then.
5. Refunds
All sales are final. We do not offer refunds for partial billing periods or unused time. Refunds for billing errors or fraud will be evaluated case-by-case. Chargebacks initiated without first contacting support may result in permanent account termination.
6. Financial Disclaimer — Read Carefully
Options trading carries significant risk of loss and is not suitable for all investors. You can lose more than your initial investment when trading options. Before trading options, read the OCC Characteristics and Risks of Standardized Options.
Surge scores, ranks, bank zones, phantom zones, probability-of-touch, wall and flip levels and similar labels are algorithmic outputs, not predictions. Past dealer positioning does not guarantee future price action. You are solely responsible for your investment decisions and any resulting gains or losses.
7. Data Sources & Accuracy
Market data is derived from third-party providers and from Unusual Whales, which supplies institutional flow, dark pool prints and earnings data. We do not warrant data accuracy, timeliness, or completeness.
- The free tier is limited to SPY gamma exposure; broader coverage requires a paid tier.
- Data access on any tier remains subject to our providers' terms.
- Alerts may be delayed, missed, or wrong; never trade on an alert alone.
- Calculations may differ from other vendors due to methodology differences.
- System outages, data provider errors, or computation bugs may produce incorrect output.
Verify all data independently before making any trading decision.
8. Acceptable Use
You agree NOT to:
- Scrape, crawl, or automatically extract data from the Service beyond reasonable interactive use.
- Reverse-engineer, decompile, or attempt to extract source code.
- Resell, redistribute, or republish Service output without written permission.
- Use the Service for any illegal activity, including market manipulation.
- Bypass tier restrictions, share paid credentials, or exploit bugs to access premium features.
- Submit false information during signup or impersonate others.
- Access our API endpoints programmatically from outside the app.
- Redistribute or resell Discord alert content commercially.
- Upload, transmit, or distribute viruses, malware, or harmful code.
9. Intellectual Property
All Service content — code, design, branding, algorithms, calculation methodologies, and visualizations — is owned by GexTweak and protected by copyright, trademark, and other laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial trading analysis. This license terminates automatically if you violate these Terms.
10. Termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud, or chargeback abuse. Upon termination:
- Your right to use the Service ends immediately.
- We may delete your account data after a reasonable retention period.
- No refund will be issued for unused subscription time.
11. Limitation of Liability
To the maximum extent permitted by law, GexTweak shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to trading losses, lost profits, lost data, or business interruption — arising from your use of the Service.
Our total aggregate liability for any claim shall not exceed the greater of $100 USD or the amount you paid for the Service in the 12 months preceding the claim.
Some jurisdictions do not allow certain liability limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Changes to Terms
We may update these Terms at any time. Material changes will be announced via email or in-app notice at least 7 days before taking effect. Continued use after changes constitutes acceptance. If you don't agree, cancel your subscription before the effective date.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Disputes shall first be attempted to be resolved informally by contacting us. Unresolved disputes shall be submitted to binding arbitration in Delaware, with each party bearing its own costs, except as otherwise required by law.
You waive any right to participate in a class action or class arbitration against GexTweak.
